Para iniciarmos o assunto, é importante assim que saibamos caracterizar e definir o que é “natureza jurídica” e “plano empresarial”. A natureza jurídica de uma empresa se refere portanto diretamente ao regime jurídico do qual ela faz parte. Ou seja, a sua relação da pessoa jurídica com as informações consonantes à administração pública.
Sendo assim, de acordo com a Lei nº 10.406/02 existem os mais diversos tipos de empresas, que podem ser tanto de direito público quanto de direito privado. Sendo assim, hoje falaremos dos tipos de naturezas jurídicas mais utilizadas para a abertura de empresas no país. São elas:
MEI (Microempreendedor Individual);
ME (Microempresa);
EPP (Empresa de Pequeno Porte);
EIRELI (Empresa Individual de Responsabilidade Limitada);
S.A. (Sociedade Anônima);
LTDA (Empresa de Responsabilidade Limitada).
Plano empresarial, como o próprio nome já diz, são assim planos contratados por pessoas jurídicas para atender a uma massa populacional específica que mantém um vínculo empregatício, associativo ou sindical com o contratante. Sendo assim, trouxemos alguns tipos de planos empresariais. Veja:

Indivíduo com vínculo a pessoa jurídica por relação empregatícia ou estatutária.
Carência
Não há portanto carência para indivíduos que ingressarem no plano em até 30 dias da celebração do contrato ou da vinculação a pessoa jurídica, em contratos com 30 ou mais indivíduos; a aplicação de carência, quando houver, segue as regras do plano individual.

Quem pode ingressar?
Empresário individual e indivíduos com vínculo a este por relação empregatícia e grupo familiar previsto no inciso VII do art. 5º da RN 195, e somente poderá assim contratar quando comprovar o exercício profissional da atividade empresarial há pelo menos seis meses.
A comprovação do efetivo exercício da atividade empresarial bem como dos requisitos de elegibilidade deverá ser assim efetuada anualmente, no mês de aniversário do contrato.
Carência
Pode haver aplicação de carência. Quando houver, segue as regras do plano individual.
